Accusations Faced 

Our client’s world turned upside down when he faced a series of serious criminal accusations.  

He was accused of intentionally causing injury, making a threat to kill, false imprisonment, assault conduct, endangering life (strangulating), endangering persons, and aggravated assault. 

A conviction could have resulted in significant jail time, hefty fines, and a damaged reputation that could have impacted his future and relationships. Determined to fight for his freedom and clear his name, our client entrusted his case to our legal team.

Our client account of the events was vastly different from the complainant’s. We started by carefully reviewing his interview with the police to understand his side and gather all pertinent details from his record.

We proactively communicated with the prosecution, presenting his interview record, which showcased his full and frank cooperation with law enforcement. By emphasising his willingness to engage openly, we aimed to establish his credibility and question the solidity of the prosecution’s case. 

3. Weaknesses in the Accuser’s Statement

After carefully examining the accuser’s statement and comparing it with other evidence, we found significant discrepancies, which raised doubts about the reliability and accuracy of the accusations. 

4. Request for Charges Withdrawal:

Based on the weaknesses in the complainant’s statement, we formally requested the prosecution to withdraw all charges against our client. We argued that there was insufficient evidence to support the serious accusations and questioned the credibility of the complainant’s account. We highlighted that the prosecution’s case was fundamentally flawed.  

Outcome and Charges Withdrawal 

After a thorough review of our submissions and the weaknesses identified in its case, prosecution accepted our request for the withdrawal of charges against our client, effectively acquitting him. 

This request was successful in clearing him of all accusations and resulted in a costs order being issued against the Chief Commissioner of Police. This order covered his legal expenses.
